Delivery and Returns

DELIVERY

The products will be shipped via courier to the address specified by the customer at the time of the order. Deliveries are made from Monday to Friday, during normal working hours, excluding public holidays. Delivery is considered complete when the product is made available to the customer at the address specified in the order form. In case of non-delivery due to the recipient's absence at the specified address, the courier will attempt delivery the following day. If delivery cannot be made the next day due to the recipient's absence, the courier will attempt to contact the customer to schedule a new delivery within the next 10 days. In case of further absence of the recipient within that timeframe, the products subject to the order will be returned to TATABORELLO, which will send a notification via email to the customer. All costs related to any subsequent redeliveries will be borne by the customer. At the time of delivery of the products by the courier appointed by TATABORELLO, the customer is obliged to carefully check that the packaging is intact and not damaged or tampered with, and that the number of pieces matches what is indicated in the transport document. Any damage to the packaging or discrepancies in the number of pieces, as indicated in the transport document, must be immediately contested with the courier and then promptly reported to TATABORELLO via email at info@tataborello.com, specifying the order number. In cases of force majeure, unavailability of transport, as well as unforeseen or unavoidable events that cause a delay in delivery or in cases where delivery is difficult or impossible or causes a significant increase in delivery costs, TATABORELLO will exercise the right to split and postpone the delivery or to terminate the purchase contract in whole or in part. In such cases, TATABORELLO will provide timely and adequate communication of its decisions to the email address provided by the customer, who will be entitled to a refund of the price already paid, excluding any subsequent claims, of any kind, against TATABORELLO.

PAYMENT METHODS

You can make the payment with a credit card, PayPal account, or bank transfer. The accepted credit cards are: MasterCard, Visa, Visa Electron, American Express, Carta Aura, PostePay. If the PayPal system denies the payment authorization, the order will be considered void, and the details for making the bank transfer will be displayed at the time of choosing the payment method. Your order will be valid from the moment Tataborello receives the bank transfer.

RIGHT OF WITHDRAWAL

Purchases made on the site Tataborello.com are governed by these general conditions and the regulations set forth in the section "acceptance of terms and conditions of sale". Pursuant to Articles 64 et seq. of Legislative Decree 206/2005 ('Consumer Code), the consumer (natural person who purchases goods for purposes not related to their professional activity, without indicating a VAT number reference) has the right to withdraw from the purchase contract for any reason and without explanation under the conditions set forth below. To exercise this right, the customer must send a communication within 10 (ten) working days from the date of receipt of the goods to the address info@tataborello.com indicating name, address, product details (code). Subsequently, the customer must return the product within ten working days from the date of receipt. In no case will the withdrawal be valid without prior notice from the customer. The customer is responsible for any issues related to the products until they are received by TATABORELLO. The cost of the refund will not be reimbursed unless the item received by the customer was sent in error, or was delivered damaged. The integrity of the item to be returned is an essential condition for exercising the right of withdrawal. It is sufficient that the goods are returned in perfect condition and complete with labels and packaging. Tataborello will not accept items returned worn or lacking labels and packaging or showing obvious signs of previous use. Failure to return the goods within the prescribed time frame will result in disqualification from the right of withdrawal. Customs duties and sales taxes are non-refundable in any case. Once the integrity of the returned product and compliance with the procedures have been verified, TATABORELLO will refund the customer the amount paid for each product for which the right of withdrawal has been exercised. The refund must take place within and no later than 30 (thirty) days from the receipt of the aforementioned products. TATABORELLO will refund the entire value of the order or the value of the individual products returned in the case of partial withdrawal via bank transfer or by other methods specifically agreed upon with the customer. It is specified that, in accordance with current regulations, in this case TATABORELLO will refund the customer the amounts paid for the returned products excluding the necessary return shipping costs.

NON CONFORMITY OF PRODUCTS AND AFTER-SALES SERVICE

The products offered on the site comply with the national and community regulations currently in force in Italy. The images and colors of the products published on the site may differ from the actual ones due to the local settings of the system and/or the tools used for their display. In case of a lack of conformity of the purchased products with respect to the written description published on the site and in case of a faulty or defective product, the customer is entitled to a replacement of the non-conforming goods within 10 (ten) days or to a free repair of the damaged goods within 2 (two) years from the date of purchase. In case of breakage of one or more items, the customer must contact customer service at the email address info@tataborello.com, indicating in the message the reference code of each individual product and the date of purchase. The return for repair must be authorized by customer service. Any shipping costs/taxes are the responsibility of the customer.

PERSONAL DATA PROCESSING

Customer data is processed by TATABORELLO in accordance with the provisions of current legislation, as specified in the information in the appropriate section 'privacy policy'.

COMMUNICATIONS AND COMPLAINTS

All communications or any complaints from customers towards TATABORELLO regarding purchase contracts must be forwarded through the appropriate contact forms on the website.

INTELLECTUAL PROPERTY RIGHTS

Tataborello Officina Bijoux is a registered trademark worldwide. All trademarks (registered and unregistered), as well as any work of the intellect, sign or name, image, photo, graphic or written text, and more generally any other intangible asset protected by copyright laws and international conventions on intellectual and industrial property reproduced on the site are the exclusive property of TATABORELLO and/or its licensees. Access to the site and/or purchase does not confer any rights to the customer. Any use, even partial, of the same is prohibited without the prior written consent of TATABORELLO and/or its licensor, for whom all rights are exclusively reserved.

PLACE OF JURISDICTION

Any dispute regarding the interpretation and execution of contracts in accordance with these terms and conditions will be resolved before the competent Judicial Authorities pursuant to the applicable regulations, in the case of 'consumer' clients, while for 'professional' clients, the competent court will be exclusively that of Turin.
